1. Acceptance of Terms

Welcome to SviestMC! These Terms of Service ("Terms") govern your access to and use of the SviestMC Minecraft server (the "Server") and its associated website located at sviests.site (the "Website"). Please read these Terms carefully before using our services.

By accessing the Website, connecting to the Server, registering an account, or otherwise using any SviestMC services, you ("User," "You") signify that you have read, understand, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Server or the Website.

We reserve the right to modify these Terms at any time. We will notify users of significant changes (e.g., via website announcement or server message), but it is your responsibility to review these Terms periodically. Continued use of the Server or Website after changes constitutes acceptance of the new Terms.

2. Eligibility

You must comply with Minecraft's own Terms of Service and End User License Agreement (EULA). By using our Server, you represent that you meet any age requirements applicable in your jurisdiction for consenting to data processing and accessing online services, or that you have obtained parental/guardian consent.

3. Rules of Conduct

While using the SviestMC Server and Website, you agree not to:

*   Cheat, Hack, or Exploit: Use modified clients, hacks, scripts, automation tools (bots), glitches, bugs, or any other method to gain an unfair advantage over other players. Reporting bugs responsibly to staff is encouraged.

*   Harass, Bully, or Threaten: Engage in behavior that targets, intimidates, demeans, or threatens other users or staff members. This includes, but is not limited to, hate speech, discrimination (based on race, religion, gender, sexual orientation, disability, etc.), personal attacks, and excessive negativity.

*   Spam or Advertise: Flood chat channels with repetitive messages, advertise external servers, websites, or services not explicitly permitted by SviestMC staff.

*   Grief or Sabotage: Intentionally destroy other players' creations, steal items (unless permitted by specific server rules/gamemodes), or otherwise disrupt the intended gameplay experience for others in disallowed ways. (Clarify specific griefing rules if necessary based on your server type).

*   Impersonate: Pretend to be a staff member or another user.

*   Share Personal Information: Post or distribute your own or others' personal information (real names, addresses, phone numbers, etc.).

*   Use Inappropriate Content: Utilize offensive usernames, skins, capes, builds, or post inappropriate content on the Website (forums, comments, etc.).

*   Engage in Illegal Activities: Promote or participate in any activity that violates local, national, or international laws.

*   Evade Bans: Attempt to bypass punishments (bans, mutes) by using alternative accounts or methods.

Violation of these rules may result in warnings, temporary mutes, temporary bans, permanent bans, or other sanctions, determined at the sole discretion of SviestMC staff.

4. Account Responsibility

You are responsible for maintaining the confidentiality and security of your Minecraft account login information. You are solely responsible for all activities that occur under your account, whether or not authorized by you. SviestMC is not liable for any loss or damage arising from unauthorized use of your account (e.g., if your account is compromised). Report any suspected unauthorized access to SviestMC staff immediately.

5. Donations and Virtual Goods (If Applicable)

*   SviestMC may offer opportunities to support the server through voluntary donations.

*   Donations are typically non-refundable.

*   In recognition of donations, SviestMC may grant certain virtual perks, items, ranks, or cosmetics within the Server. These are provided "as is" and have no real-world monetary value.

*   SviestMC reserves the right to change, modify, or remove any virtual goods or perks at any time without notice or compensation.

*   Donating does not exempt you from adhering to these Terms or any server rules. Rule violations can still result in punishments, regardless of donation status.

*   All transactions comply with Mojang's EULA regarding server monetization.

6. Intellectual Property

*   SviestMC Content: The SviestMC name, logo, website design, custom server plugins, builds created by staff, and other original content associated with the Server and Website are the property of SviestMC or its licensors. You may not use, copy, or distribute this content without explicit permission.

*   User-Generated Content: By creating content on the SviestMC Server (e.g., builds, structures), you grant SviestMC a perpetual, worldwide, non-exclusive, royalty-free license to use, host, display, modify, and distribute that content within the context of the Server and its promotion. You retain ownership of your original creative ideas.

*   Minecraft Content: Minecraft, its assets, code, and related intellectual property are owned by Mojang AB or Microsoft Corporation. Your use of the Server is subject to their EULA.

7. Website Use

When using the SviestMC Website (including forums, comment sections, etc.), you agree to abide by the Rules of Conduct (Section 3) and any additional posting guidelines provided. SviestMC reserves the right to remove any content deemed inappropriate or in violation of these Terms.

8. Disclaimers and Limitation of Liability

*   "As Is" Service: The SviestMC Server and Website are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure access. We are not responsible for any data loss, including player inventories, builds, or account progress.

*   Limitation of Liability: To the fullest extent permitted by law, SviestMC, its owners, administrators, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.

9. Termination

SviestMC reserves the right to suspend or permanently terminate your access to the Server and/or Website at any time, for any reason or no reason, without prior notice or liability, particularly if you violate these Terms or server rules. Decisions regarding bans and suspensions are typically final and made at the discretion of SviestMC staff.

10. Privacy

Your privacy is important to us. Please refer to our separate Privacy Policy for information on how we collect, use, and protect your data. 

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Latvia.
